Description

Joe Biden has been declared president elect by the media. He has won PA, it looks like he won GA, and other swing states. Do you think the courts will reverse vote counts to the point that Donald Trump remains president?

Decision Logic

Currently Joe Biden is the presumptive President-Elect. If through decisions by courts, the vote counts get changed to the degree that Donald Trump actually wins the presidency by flipping enough previously called states... then YES will win.

If Joe Biden remains the president elect then NO wins.

This will be called December 14th or when there is no further pathway for court cases to reverse the race.

Also just my personal opinion: There is no way a court would somehow rule for Donald Trump while leaving the current vote totals unchanged. That would be saying "yes more people voted for Donald Trump, legally, and yet we are still going to allow him not to be president". I do also say below that if state legislature steps in to make him president the entire vote is void and we all get our money back.

There are ton of different options for him to win, but this bet is specifically about the courts overturning illegal ballots.

Vote counts "reversing" by any court is not even necessary for Trump to win. There are multiple avenues for him to win without official tallies changing. If it goes to a house decision due to a lack of unanimous confirmation then all votes and even EC votes are irrelevant. I think it would have made more sense to explicitly state if he won through any legal/constitutional means, not necessarily only court intervention of totals.

@dddavidp The text, in my opinion, clearly lays this out. "If through decisions by courts, the vote counts get changed to the degree that Donald Trump actually wins the presidency by flipping enough previously called states... then YES will win." If a court causes previously recorded votes to be thrown out (or have additional votes counted in a situation where that would help) then YES wins. If a state sends it's own electors I will null the bet, as per comments below.

Hey @TeamColtra I just noticed the description says "If Joe Biden remains the president elect then NO wins." The thing is that is not an position in the Federal Government, and there is no Oath of Office, so what do you think about going off of whoever gets the most votes on December 14th? That truly is what decides the Presidency, so what happens if Joe Biden refuses to "step down" from the position of the President Elect?

The only thing I would say is if it's the courts just affirming what legislatures or governors do, then it's not really the courts stepping in. It's the courts affirming an action is legal, which they would do in any case. They wouldn't be overturning a result, and as per the text "vote count be changed" this would not change the vote count.

@BingoBoingo yeah I think that would be a fair argument: the courts intervened, made a decision that results in Trump not Biden assuming the presidency. If that happened I'd argue this should resolve "yes" (I bet "no" FWIW) ... it seems very improbable to me but it's definitely court action.

I ask because technically in that case while a Legislative body would be voting, the only viable path to that outcome I can see involves courts preventing states from designating electors to the electoral college.

So, in the situation where the Courts prevent either candidate from having an electoral college majority that would resolve as yes when Article 2, Section 1, Clause 3 of the US Constitution kicks in and delivers the win to Trump as each individual state's House delegation has one vote, as the decision of the courts opened the path to that outcome.

The bet doesn't specify the US supreme court, it just says "courts". If ANY legal process mediated by any court of law results in Joe Biden not becoming President Elect it seems to be "Yes" should win. If the decision is overturned say, by a normal recount that has no court interactions, NO would still win. A court was not involved.

No wins in any case where the courts do not flip the election. However, the text clearly states that no only wins if Joe Biden remains president elect. Because of this ambiguity, i will simply null the outcome in a situation where a legislature influences the election and Donald Trump wins. Everyone would get their money back.
